Terms of Service

1. Acceptance and Service Provider

These Terms of Service govern your access to and use of TunedGift, including our website, personalized song creation tools, digital wall art, audio previews, downloads, and related services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding agreement. If you use the Service for an organization, you confirm that you are authorized to bind that organization.

2. The Service and AI-Generated Output

TunedGift turns the memories and instructions you provide into personalized song lyrics, music, audio performances, private share pages, and optional digital wall art. The Service is delivered digitally. AI-generated output may contain errors, unexpected wording, inaccurate pronunciation, or other artifacts. You are responsible for reviewing output before sharing, downloading, publishing, or printing it.

Features, generation limits, supported formats, and availability may change as we improve the Service. We do not guarantee that every request will produce a particular musical style, voice, lyric, image, or result.

To help you understand the technology used by the Service, TunedGift Lyrics AI uses Gemini 2.5 Flash; TunedGift Song AI uses Suno V5.5; TunedGift Cover AI uses Suno V5.5; and TunedGift Wall Art AI uses Z-Image. We will identify the applicable model before enabling a TunedGift Video AI feature. TunedGift is independent and is not endorsed by any model provider.

3. Accounts and Security

Some features require an account. You must provide accurate information, keep your login credentials confidential, and are responsible for activity under your account. Notify us promptly through the support form if you suspect unauthorized access. We may suspend or terminate accounts that contain false information or violate these Terms.

4. Plans, Billing, and Payment

We offer one-time digital products and recurring subscription plans. The applicable price, currency, billing interval, taxes, included features, and any limits are shown at checkout before you complete payment.

Payments are processed by Waffo Pancake and its payment entity, Waffo.com Limited, which may act as the online reseller and merchant of record. Waffo may appear on your payment statement and may process payment-related support, tax, invoicing, and refund transactions under its own terms and policies. TunedGift does not store complete payment-card numbers.

For a subscription, you authorize the applicable recurring charge at the monthly or annual interval selected at checkout. Subscriptions renew automatically unless you cancel before the next renewal date. A price change will be shown before it applies to a new billing period, where required by law.

5. Cancellation and Refunds

You may cancel an active subscription through the billing controls in your TunedGift account. Cancellation takes effect at the end of the current paid billing period; you retain access until then and will not be charged for a subsequent renewal.

Because personalized songs and digital wall art are digital products made to your instructions, one-time purchases are generally non-refundable after generation or delivery has started. If we cannot deliver the purchased product because of a verified technical failure, contact support with your order details so we can provide a replacement or refund where appropriate.

Subscription fees already charged for the current or a prior billing period are generally non-refundable and cancellation does not create a pro-rata refund. We will review verified accidental duplicate charges, unauthorized charges, or refunds required by applicable consumer law.

Nothing in these Terms limits a mandatory consumer right that cannot lawfully be waived.

6. Acceptable Use, Content Safety, and Reporting

You must not use the Service to:

• Violate any applicable law or regulation.
• Create pornographic, sexually explicit, or NSFW content.
• Create violent, graphic, gory, abusive, self-harm, or threatening content.
• Create hate speech, harassment, discrimination, or incitement of hatred.
• Create, request, upload, promote, or distribute Child sexual abuse material (CSAM), or any sexualized depiction of or sexual request involving a minor. This is zero tolerance.
• Create non-consensual deepfakes, impersonation, or use another person's voice or likeness without authorization.
• Submit content that you do not have the right to use, including content that infringes copyright, trademark, privacy, publicity, or other rights.
• Promote terrorism, violent extremism, mass violence, weapon-making assistance, fraud, malware, security bypasses, or abusive automation.
• Resell access to the Service or use it to provide an unapproved competing service.

TunedGift screens relevant user-supplied generation instructions before generation. We proceed only when the screening result allows the request. We hold or reject requests that are blocked, require review, or cannot be screened; we do not bypass those checks. Model-provider safeguards and user reports are additional protections, but generated output is not represented as separately screened in every case.

If you believe content or use of the Service violates these rules, Report a concern. We review reports according to their severity and may remove content, revoke a share link, restrict generation, suspend or terminate an account, or report severe illegal material when legally required. We may also refuse, remove, or limit content and requests that reasonably create legal, safety, or operational risk.

7. Your Content and Generated Output

You retain the rights you hold in the text, memories, images, and other material you submit (“Input”). You grant TunedGift a limited, worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, and process Input only as needed to provide, secure, troubleshoot, and improve the Service.

Subject to these Terms and any rights of third parties, you may use the generated lyrics, music, audio, and artwork (“Output”) for your personal gift and sharing purposes. Outputs may not be unique, and third-party model or platform terms may apply. You are responsible for checking that your Input and use of Output comply with applicable law and third-party rights.

8. Intellectual Property

The Service, software, branding, interface, and TunedGift-created materials remain owned by TunedGift or its licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, reverse engineer, distribute, or commercially exploit the Service itself without our written permission.

9. Third-Party Services

The Service may rely on third-party providers for payment processing, cloud hosting, storage, analytics, email, and AI generation. Their services may have separate terms and privacy policies. We do not control and are not responsible for a third party’s availability, security, decisions, or policies.

10. Suspension and Termination

We may suspend or terminate access, remove content, or refuse service if you breach these Terms, create risk for users or providers, or use the Service unlawfully. You may stop using the Service at any time. Termination does not create a refund right except as stated in Section 5 or required by law.

11. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNEDGIFT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION. WE DO NOT GUARANTEE THAT OUTPUT WILL MEET YOUR EXPECTATIONS, BE UNIQUE, BE SUITABLE FOR A PARTICULAR RECIPIENT OR PLATFORM, OR BE FREE OF THIRD-PARTY CLAIMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNEDGIFT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR LOST-PROFIT DAMAGES ARISING FROM THE SERVICE. TUNEDGIFT’S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TUNEDGIFT FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limitations apply only to the extent permitted by applicable law.

13. Indemnity

You agree to defend, indemnify, and hold harmless TunedGift and its service providers, officers, employees, and licensors from claims, losses, liabilities, and reasonable costs arising from your Input, your Output or use of Output, your breach of these Terms, or your violation of another person’s rights.

14. Changes to These Terms

We may modify the Service or these Terms. For material changes, we will update the date above and provide notice through the Service or by email where reasonably practicable. Continuing to use the Service after the effective date means you accept the updated Terms.

15. General

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning the Service, subject to any additional terms shown at checkout.

Include your order or transaction ID when available. Payment-related requests may also be handled by Waffo.com Limited under the contact instructions in your checkout receipt.
